We think this bill violates your 8th and the 14th amendments, is unconstitutional and needs to be repealed. If SB10 is not repealed, you will be at the mercy of the government if you are released or kept in jail before trial. You will no longer be able to post a bond for your freedom.

The Referendum process in California is straightforward.  SB 10 was signed by Governor Brown on August 28, 2018.  In order to get the Referendum to Repeal SB 10 on the November 2020 California General Election Ballot, proponents of the Referendum must obtain the signatures of 365,880 registered voters within 90 days of the Governor signing SB 10.  (The number of signatures needed must equal 5% of the votes cast for all candidates for Governor at the last Gubernatorial election.  Based on the last election in 2014, this total is 365,880.)  The Petition with the required number of signatures must be submitted to the Secretary of State for signature qualification by November 26, 2018.  By January or early February 2019, the Secretary of State will confirm the qualification of the Referendum, meaning it will be placed on the November 2020 General Election Ballot.

Importantly, if the Referendum gets qualified by the Secretary of State as having the required number of valid signatures,    SB 10 cannot not be implemented in October of 2019, but only after the November 2020 General Election.  In other words, the qualification of a referendum against an enacted and signed new law has the legal effect of delaying that law from taking effect until the voters weigh in on it.  If the Referendum is passed by the voters, SB 10 is repealed.  If not, SB 10 will have an effective date of October 2021, nearly three years from now.  In other words, the Referendum process prevents the implementation of SB 10 until the voters get to vote on its repeal.
