I'm often asked the question, "My son has court tomorrow, do you think they will lower his bail?" The best way for me to answer this question is to give my clients scenarios on what could happen. With that said, let's take a look at some of the most likely options: 

          1. Bail will remain the same.
          2. Bail is increased
          3. Bail is lowered
          4. Bail is dropped and inmate is released 
          5. No bail allowed

There are many different variables affecting the judges decision and each case is different. The judge will be looking at your:

          1. Past history
          2. Charges you are facing
          3. Your standing in the community. 

Having your bail stay the same - you will most likely would not of had similar charges brought against you in the past. If you have never been arrested before you may even be released on your own recognizance. This is on a case by case decision made by the judge. The court will also look at your standing in the community and assess the likelihood of you returning to court without bail. Waiting in jail for your court date and hoping that your bail is lowered is a risky bet. I always advise my clients to bail out if they can and fight your case as a free person. Another point to consider, is what are your charges? In the past three years, all my clients that have been charged with domestic violence and have bonded out - most had their cases dropped. Clients that waited until their court date hopping for their bail to be lowered had mixed results. Some had their bail raised, others lowered and some bails remained the same.

Having past history of the same charges may be reason enough for the court to raise your bail amount or even take away the option for bail altogether. When your freedom is a risk don't go it alone.
